Terms and Conditions of Smart Web Dev

Smart Web Dev is a duly registered business in Guatemala. By requesting, hiring, or paying for any service through this website, you agree to the terms described below.

1. What we offer

Smart Web Dev provides technical services: the design, development, and maintenance of websites and web applications, delivered as a technical service rather than a regulated professional practice (such as licensed engineering). Nothing on this site should be read as an engineering opinion, an audit, or any other form of certified professional advice — for that, consult an appropriately licensed professional in the relevant field.

What we do offer is practical, verifiable experience: a public portfolio of working projects you can try before you hire us.

Promotions, such as the first free website, follow the conditions published on their own page (for the free website: free website request): the number of available spots, one per person, and any stated requirement. A promotion includes only what that page lists, and it ends when the spots are filled.

2. Scope and limitations

The scope of each project is whatever is explicitly agreed upon before work begins (in writing, by email or an equivalent channel). We do not guarantee specific business outcomes for the client — sales, traffic, rankings, or revenue — since those depend on factors outside our control. We do not provide legal, tax, financial, or medical advice through any service on this site.

3. Prices and payment

Prices are quoted in Guatemalan Quetzales (GTQ) or US Dollars (USD), as stated at the time of purchase. Displayed prices are final: Smart Web Dev is registered under Guatemala's Pequeño Contribuyente tax regime, so no separate VAT (IVA) line is added on top of the listed price.

Depending on the service, we may request an upfront deposit before starting work, with the balance due upon delivery or per agreed milestones. Accepted payment methods are shown at checkout.

4. Invoicing

Every payment is billed through Guatemala's FEL (Factura Electrónica en Línea) system. Because Smart Web Dev is a Pequeño Contribuyente, the document issued is a Small Taxpayer Invoice (FPEQ) — a flat-rate receipt rather than a standard VAT invoice, and it does not generate VAT tax credit for the buyer.

5. Refunds and cancellations

You may request a refund or cancel a service before work has started, in which case any deposit paid will be returned in full. Once work has started, refunds are evaluated case by case based on the portion of the agreed scope already delivered. Work already delivered and accepted is not refundable.

6. Limitation of liability

Smart Web Dev's liability for any claim related to a service is limited to the amount actually paid for that service. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data, except where such limitation is not permitted by applicable law.

7. Governing law

These Terms are governed by the laws of the Republic of Guatemala, including the Law for the Protection of Consumers and Users (Decree 6-2003).

8. Changes to these Terms

We may update these Terms from time to time to reflect changes in our services or in applicable law. Continued use of our services after an update constitutes acceptance of the revised Terms.
